La protección del salario en las empresas insolventes: los privilegios del crédito salarial

This paper analyse wage guarantees of the anticipated wage credit in the Insolvency Law, comparing them with the guarantees regulated in the Statute of the Workers, these last only applicable for non insolvency situations. This study tries to pose the underlying problems to this double system of guarantee of the wage credit, emphasizing the problems of the wage credit in the insolvency process. The preferences of payment of the wage credit are analyzed in a broad sense , that is to say, including not only the wage in strict sense, but also the indemnifications, benefits of social security in charge of the employer and amounts derived from the enterprise civil responsibility in labor matter.
