espanolEl trabajo se enfoca en un costado poco explorado del caso “CEPIS”, en el que la Corte Suprema de Justicia Argentina anulo el aumento en las tarifas del servicio publico de gas natural (2016). En particular, busca demostrar que la Corte Suprema opto por una solucion politica del conflicto, no juridica. Y para ello, modifico aspectos procesales y sustanciales del caso. Para ello, el trabajo identificara dos cambios arbitrariamente impuestos que modificaron por completo el fondo de la cuestion a resolver. Tambien identificara una “pista falsa en el camino” colocada por la Corte para distraer a los distintos auditorios y lograr que su sentencia fuera recibida como una muestra de independencia judicial, cuando fue lo contrario. La conclusion resaltara la necesidad de que la sociedad cuente con mejores herramientas para poder advertir cuando el ejercicio discrecional de la judicatura se convierte en arbitrario, alejado de todo Estado de Derecho Constitucional. EnglishThis essay focuses on an unexplored aspect of the “CEPIS” case, in which the Supreme Court of Argentina nullified two administrative resolutions that ordered a substantial rate increase of the natural gas public service (2016). Particularly, it aims to demonstrate that the Supreme Court delivered a political solution for the conflict, not a legal one. To do so, the Court modified procedural and substantial aspects of the case. To demonstrate this, the essay will identify two changes imposed by the Court that totally modified the merits of the case. It will also identify a “false print in the way”, used to distract the Court´s auditoriums and make this ruling to be well-received by the public opinion. The final conclusion will assert how important is for the civil society to have efficient institutional tools to know when the discretional power of the judicature becomes arbitrary, against the Constitutional State.
