LEGAL-CONSITUTIONAL CHALLENGES AND POLITICS IN COVID-19 PANDEMIC TIMES: CRITICAL ANALYSIS OF ADMINISTRATIVE REQUIREMENTS ON PRIVATE HEALTH CARE GOODS AND SERVICES

This article discusses the implementation of the largest health access system formulated in the United States in the last fifty years: Obamacare. Its purpose is to identify the main regulatory aspects of the program, as well as to reproduce its results based on studies that were prepared following its implementation. In particular, the article focuses on two regulatory objectives: cost reduction through increased scale, fostered by the inclusion of new consumers in the system, accompanied by greater guarantee of permanence through government subsidies and the mitigation of asymmetry problems information, mainly due to the mandatory inclusion of consumers with pre-existing diseases and the setting of minimum coverage standards. In addition, changes that occur in this system after the election of Donald Trump and its impact on the US health system will be demonstrated, relating those changes specifically to conditions of access and long-term sustainability.
