Medicolegal Perspective on Physician-Induced Demand Issue

2021
This study sheds light on the extent to which the medical law protects patients' rights from Physician-Induced Demand behavior. This study shows that the term of Physician-Induced Demand is not recognized in multi health regulations, but it does not mean that the law permits Physician-Induced Demand. Substantively, Physician-Induced Demand disguises an action that can manipulate and harm the patient's best interest. At the same time, in the law, it is insisted that a doctor must take medical efforts following professional standards and standard operating procedures. Not only that, but the law also demands that medical treatment must be based on sound principles, such as the principle of quality, honest, fairness, humane, without discrimination, efficiency, and effectiveness. Physician-Induced Demand as a medical action in which oriented to the interests of a physician is opposed to the law. Therefore, this study argues that Physician-Induced Demand violates the principles of medical law. It should be avoided under any circumstances.
