Does the International Court of Justice make international law? Should it do so? / As cortes internacionais fazem direito internacional? Elas deveriam faze-lo?

DOI:10.12957/dep.2014.10307 Abstract This article investigates whether the judicial decision is and should be an activity of merely “law-applying” or of genuinely “law-making”. The theoretical problem of adjudication is seen from the perspective of the International Court of Justice (ICJ), a central forum of many-faceted conflicts in international law. The article tries to escape the rigidness of a “logic of either or” (either creation or mechanical application) and to see the nuances between both extremes. Judges neither create nor apply in the sense these concepts are usually used. Key words: International Court of Justice; law applying; law making Resumo O presente artigo analisa se as decisoes judiciais sao atividades que apenas aplicam ou criam o direito. A questao teorica sobre adjudicacao e vista a partir da perspectiva do Tribunal Internacional de Justica, forum responsavel por decidir varios conflitos de direito internacional. O artigo tentou escapar da rigidez de uma logica binaria (ou criacao ou aplicacao mecânica do direito) e ver as nuances entre os dois extremos. Juizes nem criam nem aplicam o direito no sentido em que estes conceitos sao normalmente utilizados. Palavras-chave: Tribunal Internacional de Justica; aplicacao do direito; criacao do direito.
