La nulidad del crédito de Argentina con el Fondo Monetario Internacional

2021
The paper analyzes the legal and procedural conditions on the basis of which, in June 2018, the Argentine Republic contracted with the International Monetary Fund (IMF) a credit stand-by for the sum of $ 50,000,000,000, later extended by $ 7,100,000,000. It also explains the actions developed in terms of strategic litigation to obtain public information on the issue, and maintains, as is judicially requested, that the credit and its extension are manifestly and absolutely null and void. This nullity derives not only from the fact that the credit was taken by the Executive Branch without the intervention of Congress, but also because it had violated various national laws. In particular, essential requisites established by the Financial Administration Law No. 24,156 (LAF) and the National Law of Administrative Proceedings No. 19,549 (LNPA).
