Hong Kong's Revised Leniency Policy and Its Potential to Deter Cartels

The present chapter assesses the special design and characteristics of Hong Kong’s revised leniency policy, and discusses its suitability to tackle the city’s cartels. The analysis largely reveals a thorough, sharply devised tool with significant potential, but somewhat hampered by the HKCO’s shortcomings. To explore the merits of the system, the chapter consists of six sections. Section I is the introduction. Section II looks at the general framework of the city’s competition legislation. Thereafter, section III discusses cartels in Hong Kong and the HKCC’s activity against cartels to date. Section IV focuses on the details of the leniency policy, and a critical discussion of these is carried out in section V. Section VI concludes.
