On Absurd of the System of Specific Administrative Acts by Courts——From the Court's Review on the Application of Enforcement

An uncredable system is unlikely become reasonable through theoretical amendment or selecting specific operating mode.So does the system of Specific Administrative Acts by Courts in China.Although there are three different viewpoints and methods to review of the implementation of the Perspective for china's courts:substantive examination、the form of examination and clear illegal examination,but because it is itself unreasonable for the basic system of Specific Administrative Acts by Courts,therefore,no matter whether the courts to select any method of the review,the system is completely unable to get rid of the double predicament for theory and practice.Reconstruction of china's administrative enforcement system is imperative.
