ANÁLISE DA CONTRIBUIÇÃO DO DIREITO SISTÊMICO NA RESOLUÇÃO DA PARTILHA DE BENS NO DIVÓRCIO LITIGIOSO

The present study has the objective of identifying the possibility of applying Systemic Law in the resolution of conflicts resulting from litigious divorce, focusing on the sharing of assets, using the Family Constellation, a technique created by Bert Hellinger, which has the objective of helping the individual to identify his problems and showing him a direction so that they can be solved, through collective sessions, with the help of other people, or individual sessions, using dolls that represent the individuals. The conclusion is given by analyzing the three systemic laws that govern the Family Constellation, applied to spouses' conflicts. The research method used was the bibliographic, in which the conclusion was made through consultations on legislation and books. The purpose of this article began with the interest in discovering and analyzing the applicability of new ways of resolving such controversy, in order to reduce the filing of litigious demands. Therefore, at the end of the study, it was possible to affirm the possibility of using Family Constellations in the Judiciary, based on Article 3, Paragraph 2 and 3, of the Civil Procedure Code, which authorizes each Court to organize the possibility of its execution , and it is up to him to choose the form of its implementation.
