Detention: Legal Framework for the Care of Those in Detention and the Prohibition/Prevention of Torture, Cruel, Degrading or Inhuman Treatment

International human rights law provides a comprehensive framework for the protection of persons in detention, notably by means of the absolute prohibition of torture and other forms of ill-treatment and the right to respect for human dignity. Furthermore, this law offers a wide set of safeguards, including the right to an effective remedy and fair trial guarantees. Nevertheless, there is a considerable gap between human rights norms and their practical implementation. By widening the knowledge on human rights norms and mechanisms, it is to be hoped that there will be a concurrent advancement of the protection and promotion of the rights of persons in detention, to ensure a dignified existence for those too often forgotten by society and their reintegration into society after their release.
