Judicial independence is the fundamental basis of a democratic State and must therefore be guaranteed and respected by all State bodies. In order to enjoy such independence, it is necessary to structure an institutional and regulatory model that reduces internal and external interference; and at the same time, to ensure that such a structure does not imply isolation from the social, economic and political context; in other words, the independence of judges must be accountable and democratic. The aim is to analyse the significance, advantages and implications of the structure of the Judiciary Council for guaranteeing judicial independence. The result is a systematization of the arguments of the importance of judicial independence for a correct defence of people's rights.
