Cuestiones sobre tutela, curatela y guarda de hecho en la ley de jurisdicción voluntaria

espanolLa tutela, la curatela y la guarda de hecho son tres instituciones fundamentales de guarda y proteccion legal recogidas en nuestro ordenamiento, tanto en el Codigo Civil como en la ley de jurisdiccion voluntaria. Cumplen la funcion de amparar la persona y bienes de los menores que no estan sujetos a la patria potestad de sus padres y de mayores de edad incapacitados. En este trabajo tratamos sus principales caracteristicas, nos referimos a su regulacion legal y estudiamos parte de la jurisprudencia existente al respecto. Hacemos mencion a la poca regulacion que una figura tan presente en la practica como la guarda de hecho encuentra en nuestro ordenamiento juridico y analizamos distintos puntos de vista alrededor a estas tres figuras. Se trata de ordenar lo que libros, revistas y manuales nos dicen sobre la tutela, la curatela y la guarda de hecho, poniendolo en relacion con la jurisprudencia actual. EnglishThe guardianship, curatorship and factual guardianship are, in fact, three fundamental institutions of guardianship and legal protection included in our legislation; in the Civil Code and in the law of voluntary jurisdiction. They fulfill the function of protecting the person and property of minors who are not subject to the parental authority of their parents and of disabled adults. In this work, we deal with its main characteristics, we refer to its legal regulation and we study part of the existing jurisprudence in this regard. We specially mention the little regulation that a figure as present in practice as the factual guardanship actually finds in our legal system and we analyze different points of view around these three figures. It is about ordering what books, magazines and manuals tell us about guardianship, curatorship and factual guardianship, putting it in relation with current jurisprudence.
