CONSIDERAÇÕES SOBRE A IMPLEMENTAÇÃO DE COMITÊS DE BACIAS HIDROGRÁFICAS DE RIOS FEDERAIS - O CASO DO COMITÊ DE BACIA HIDROGRÁFICA DO RIO PARANAÍBA

O objetivo desse artigo foi analisar como a articulacao institucional interfere no processo de implementacao e funcionamento dos Comites de Bacias Hidrograficas estabelecidos pela Lei n° 9433, que instituiu a Politica Nacional de Recursos Hidricos. A area utilizada como estudo foi a bacia do rio Paranaiba, cujo curso principal do rio compreende o Distrito Federal, Goias, Minas Gerais e Mato Grosso do Sul. Trata-se de uma bacia onde a crescente pressao sobre os recursos hidricos tem provocado situacoes conflituosas devido ao incremento do uso da agua para multiplas atividades. A abordagem com enfase na dimensao institucional demonstrou ser interessante por permitir a analise da interacao entre diversas variaveis: legislacao, regulacao; estruturas administrativas; arranjos economicos; estruturas politicas e valores tradicionais. O estudo abrangeu pesquisa na literatura sobre gestao hidrica, analise de dispositivos legais e entrevistas aplicadas aos atores envolvidos na implementacao daquele Comite. As reflexoes sobre as informacoes obtidas levaram a conclusao de que as principais dificuldades para a implementacao de um Comite naquela regiao sao a falta de articulacao e fragilidade institucional alem da fragmentacao de responsabilidades. Procurou-se analisar os recursos hidricos num contexto mais amplo, o ambiental, para posteriormente oferecer subsidios a gestao desse recurso na bacia do rio Paranaiba. --------------------------------------------------------- This article describes and discusses the ways in which institutional arrangements can interfere in the implementation of hydrographic basin comittes, established by the National Police for Water Resources (Law 9433 01/1997).The study area was the Rio Paranaiba basin whose main stream comprises the Federal District and the states of Goias, Minas Gerais and Mato Grosso do Sul. The hydrographic basin has been under a growing pressure upon its water resouces. Such situation occurs due to an increment in the water demands for multiple uses, which are leading to various types of social conflicts.The focus on the institutional dimension of the question proved to be important since it allows a more comprehensive analyses showing the interaction of several variables such as: legislation, regulation, administrative structures, economic arrangements, political structures and traditional values. The study comprised a review on the literature concerning water management, an analyses on the legal instruments and interviews with the stakeholders involved in the implementation processs of the Comittee. An analyses and discussion on the gathered information lead to the conclusion that the main difficults to the implementation of the Paranaiba Comittee are relatated to a lack of an appropriated institutional arrangements, an existing institutional fragility and fragmentation of responsabilities.The analyses on the water resources considered the wide environmental context, which allowed to the presentation of more comprehensive subsidies to the water management of the Rio Paranaiba Basin.
