Remedy at Law. Reclassification Under Article 457 of the New Civil Procedure Code. Dismissal as Inadmissible

The Court treated as an appeal the remedy at law entitled recourse, pursuant to article 24 and article 152 NCCP, considering the provisions of article 8 of the Law no. 85/2006, as amended by article 59 Title IV of the Law no. 76/2012, in conjunction with article 7 of the same law, and considering the time of application for opening insolvency proceedings.
