Briefly on Purposive Criminal

Purposive criminal is a kind of crimes that composes of specific criminal purposes,but as the composition of criminal purposes,it must be limited to the explicit stipulation of criminal law.Although the common saying in the field of criminal law theory at present is not limited to the explicit stipulation of the criminal law as the purpose of the specific criminal purposes,based on the negative consideration of statutory crime,fighting crime,and judicial operations,the scope of the purposive criminal cannot be extended theoretically.For the nature of the purposive criminal,the doctrine of criminal motivation has been adopted by many scholars in China.The nature and property of the criminal motivation lie in a purely subjectively psychological need,which cannot directly be observed and determined,and only can be speculated according to stimulation or reaction,with no objectivity.As the purpose of the explicit stipulation of criminal law,its property can be externalized and is a measured criminal purpose of objectivity.
