Kidnapping involving threats to life or serious bodily harm

As one of the most complex criminal phenomena, which consists of unlawful deprivation of liberty and coercion or extortion, kidnapping used to be rare in our practice. However, in the last decade the incidence of planning and execution of kidnappings in Serbia has become alarming. Kidnapping is increasingly manifested as an act of organized crime. Therefore, in operational research and the judicial investigation of this crime special investigative techniques are allowed. Transformations in the practice of perpetrating abduction have always been monitored our legislative authorities, so that all novelties concerning this act were provided for in the criminal law from mid 1976s to the end of 2009. Based on this, the paper analyzes the current legal provisions, manifestations and the problem of demarcation of the criminal acts of abduction, with special emphasis on the cases which involve threatening by murder or inflicting serious bodily injury. .
