O desenho institucional da reforma regulatória e as falhas de mercado no setor saúde

This paper analyzes the development of the new regulatory regime in Brazil. It shows the correlation between the new regulatory public policy and the privatization process that has occurred in the last two decades. It discusses how the independent regulatory agency model has been adopted as an administrative norm by the public administration. The health sector's new regulatory functions were used as an example of innovative procedure to deal with market failures and to guarantee the public interest.
