Warden's Court - back to the basics

A recent decision of the Warden's Court of South Australia, Borthwick and Ors v Australian Graphite Pty Ltd [2015] SAWC 1 concerned the determination of exempt land and the jurisdiction of the Warden's Court to rule in such a matter. The purpose of the exempt land provision is not to protect the land for environmental purposes, but to protect a landowner's interest in the commercial, domestic and social uses of the land.
